Contestant Terms & Conditions

Definitions

1. “Contestant” means anyone invited by 42 Below to attend and participate in the competitive element of the Event.
2. “Event” means the 42 BELOW Cocktail World Cup 2011.
3. “I” means the person agreeing to this Term Sheet.

Media and Image Rights

1. I understand that there will be lots of media present at the Event
2. I authorise 42 Below to capture and make records of my image and participation in the Event in any format whatsoever, whether as a photo, video, digital media or otherwise.
3. I agree that 42 Below may, at its sole discretion, edit, modify or otherwise amend any record of my image or participation in the Event and publish it in any form or media that it sees fit.
4. I agree to waive all rights and claims against 42 Below with respect to any claims or causes of action I may have for defamation, invasion of privacy or right of publicity, infringement of copyright or otherwise arising from my participation in the Event.
5. I agree that any record of my image or participation in the Event taken by or on behalf of 42 Below shall be owned by 42 Below and I hereby waive all rights to it including fees, payments, royalties or other benefits associated with it.

Conduct of Event

1. I agree that I will comply with all reasonable directions of 42 Below in relation to the Event, especially where they relate to the health and safety of anyone (including myself) attending or taking part.
2. I agree that 42 Below may, at its sole discretion, vary the format or timing of any element of the Event if it reasonably believes it is required to ensure that it is conducted in a professional and/or safe manner.
3. I understand that, except as specifically set out in these terms and conditions, I am not obliged to participate in any event or activity. I agree that if I choose to participate in any aspect of the Event it is entirely at my own responsibility. To the maximum extent permissible at law, I hereby relieve 42 Below of any and all liability for anything that may happen to me during the Event.
4. I agree that if at any time during the Event I materially breach any of the obligations set out in these terms and conditions or otherwise behave in a significantly reckless, irresponsible or dangerous manner that 42 Below may withdraw my right to participate any further in the Event and may require me (at my own expense) to return home.

General

1. I agree that 42 Below can assign any or all of its rights or obligations under this agreement without further consent. I understand that 42 Below is a trading name of Bacardi Global Brands Limited of 28 Dorset Square, London, NW1 6QG, Great Britain.
2. I warrant that I am over the legal age to drink in my country of residence and that in any case I am over the age of 18.
3. I warrant that I have a reasonable and legitimate belief that I am entitled to attend the Event in the capacity of a Contestant.
4. All contestants agree to comply with the Bacardi Corporate Social Responsibility Guidelines (as outlined below) when loading content onto their own personal webpage and any webpage. Contestants agree that 42 Below can demand the instant removal of any content that it feels to be in breach of these guidelines. Removal must occur within 24 hours of notification of the breach
   1. The Bacardi Corporate Social Responsibility Guidelines are as follows:
      1. Do not portray consumption of alcohol in an excessive/irresponsible manner
      2. Do not promote medicinal properties or promote sexual success associated with consuming alcohol.
      3. Do not show images of any person under the age of 25.
      4. Do not show any images or references that appeal to children
      5. Do not show images of consuming alcohol whilst operating machinery or driving
      6. Do not promote violent, antisocial or destructive behaviour
      7. Do not promote any association with drug culture
      8. Do not cause confusion with soft drinks/confectionary
      9. Remain sensitive to race, religion and culture

Privacy

1. I have read and understood 42 Below's privacy policies as set out in clauses 14 to 18 of the Terms and Conditions and acknowledge that they apply to all circumstances surrounding or relating to my participation in the Event.
2. I have read, understood and hereby record my agreement to the Contestant Terms and Conditions.

Judges Terms & Conditions

Definitions

1. “Event” means the 42 BELOW Cocktail World Cup 2011.
2. “I”, “me” and “my” refers to the person signing these terms, who is acting as a judge at the Event.

Judges Stuff

1. I agree to attend the full program of events at the Event as advised by 42 Below.
2. In addition to attending events, I agree to provide the following services to 42 Below during the Event:
   1. Judge contestants’ cocktails and/or performance in the challenges during the week;
   2. Perform a 42 minute educational seminar during the Event on a topic and at a time and venue to be advised by 42 Below;
   3. Be available for press and media interviews whilst in New Zealand before, during and after the Event;
   4. Judge the final contestant event on Friday 18th March, 2011.
3. In return for my services as a judge and industry expert, 42 Below agrees to provide me with the following:
   1. Flights to Queenstown, New Zealand from specified ‘home’ location for me. I will receive a business class (US first-class equivalent) return ticket.
   2. Accommodation during the duration of the Event me at a suite in the Heritage Hotel in Queenstown, New Zealand. This includes room and breakfast only; all other charges will be my responsibility to pay on checkout from the hotel.
   3. 42 Below may at its sole discretion authorise me to incur any other expenses, provided they do so in writing and in advance of incurring them.

2. I acknowledge that 42 Below operates within the Bacardi Corporate Social Responsibility Framework and as such I agree to comply with these guidelines as set out below when participating in all events:

3. I warrant that I am over the legal age to drink in my country of residence and over the age of 18.
4. I agree that these terms and conditions shall be interpreted in accordance with New Zealand law and subject to the exclusive jurisdiction of the New Zealand courts.
